Acceptance of these terms

By downloading, installing, accessing, or using any KingNerd application or this website, you agree to be bound by these Terms and by any applicable app-specific terms. If you do not agree, you must not use our software or website. If you are using an application on behalf of an organisation, you represent that you have authority to accept these Terms on its behalf.

Eligibility

You must be legally capable of entering into a binding contract in your jurisdiction, and old enough to do so under applicable law, to use our applications. You are responsible for ensuring that your use of our software is lawful in the place where you use it.

Licence to use our software

Subject to these Terms and any applicable store rules, KingNerd grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to install and use, for your own lawful purposes, any application you lawfully obtain. You must use each application in accordance with applicable law and its documentation.

Restrictions

Except to the extent that applicable law expressly permits otherwise, you agree not to:

• copy, reproduce, rent, lease, lend, sell, resell, sublicense, or otherwise distribute the software;
• modify, adapt, translate, or create derivative works from the software;
• reverse engineer, decompile, or disassemble the software, or attempt to derive its source code;
• circumvent, disable, or interfere with security-related or technical protection features;
• remove, alter, or obscure any proprietary notices, labels, or marks; or
• use the software in any unlawful manner, or in any way that could damage, disable, or impair it or interfere with any other party's use of it.

Your content and responsibilities

You are solely responsible for the information and content you enter into an application, for its accuracy, for any backups you choose to make, and for all decisions you make using an application. You must not upload or enter information that you do not have the right to use. If you use an application for work or on behalf of a third party, you are responsible for obtaining any authority, consents, and notices that may be required.

Purchases, updates, and availability

Prices, billing, subscriptions, cancellations, and refunds for purchases made through an app store or payment provider are governed by that store's or provider's terms, not by us. Features may be added, changed, updated, suspended, or discontinued at any time. While we strive to provide reliable software, we do not guarantee that every application, feature, device, data source, or update will be available, uninterrupted, timely, secure, or error-free.

Third-party services

Some applications rely on or interoperate with third-party services, data sources, or platforms. Your use of those services is subject to their own terms and privacy notices, and KingNerd is not responsible for the availability, accuracy, or conduct of third-party services.

Intellectual property

The software, this website, and all associated names, logos, designs, text, graphics, and other content are owned by KingNerd or its licensors and are protected by intellectual-property and other applicable laws. Except for the limited licence expressly granted in these Terms, nothing here transfers to you any right, title, or interest in our intellectual property.

Disclaimers

To the fullest extent permitted by law, the software and website are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Additional important limitations, including our financial disclaimer, are set out on our Disclaimers page and form part of these Terms.

Limitation of liability

To the fullest extent permitted by law, KingNerd and its licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the software or website. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the software will not exceed the amount you paid, if any, for the application giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and any mandatory consumer rights that apply to you are not affected or restricted by these Terms.

Indemnification

To the extent permitted by law, you agree to indemnify and hold KingNerd harmless from any claims, losses, liabilities, and reasonable expenses arising out of your misuse of the software, your violation of these Terms, or your infringement of the rights of any third party.

Termination

These Terms apply for as long as you use our software. We may suspend or terminate your licence if you materially breach these Terms or use the software unlawfully. You may stop using and uninstall an application at any time. Provisions that by their nature should survive termination — including those on intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.

Governing law and changes

These Terms are governed by the laws of Romania, except where mandatory consumer-protection law in your country of residence provides otherwise. We may update these Terms from time to time; where an update takes effect, your continued use of the software after that date constitutes acceptance of the updated Terms to the extent permitted by law.
